                                   GENERAL TERMS AND CONDITIONS AT CHERRYTREE RESORT  , DHARA HARWAN , SRINAGAR


GUEST IDENDTITY: The primary guest must be at least 18 years of age to be able to check into the Homestay. It is mandatory for guests to present valid photo identification at the time of check-in. According to government regulations, a valid Photo ID must be carried by every person above the age of 18 staying at the Homestay. The identification proofs accepted are Aadhar Card, Driving License, Voter ID Card, and Passport. Without Original copy of valid ID the guest will not be allowed to check-in. PAN card is not accepted as a valid ID card.

GUEST BEHAVIOUR: Should any action by a guest be deemed inappropriate by the homestay, or if any inappropriate behaviour is brought to the attention of the homestay, the homestay reserves the right, after the allegations have been investigated, to take action against the guest. Guests are requested not to disrupt the comfort and culture of our members of staff. We reserve the right to refuse accommodation or services or remove you and members of your party from the premise if, in our reasonable opinion, we consider this provision to have been breached. Where this is the case shall have no obligation to refund you for lost accommodation, other services or any other loss or expense incurred. Should any action by a guest be deemed inappropriate by the homestay, or if any inappropriate behavior is brought to the attention, the homestay reserves the right, after the allegations have been investigated, to take action against the guest as per the norms & rules in J&K state.

 

EXCESSIVE NOISE AND PARTIES : T​o ensure all guests enjoy the comfort and safety of the facilities we offer, the Homestay upholds a strict zero tolerance policy towards commotion, excessive noise and parties. Any person found to be on our premises creating excessive noise, having a party, exceeding the numbers of permitted guests or otherwise causing a disturbance will be requested to leave the hotel without refund.

PETS: Pets are not allowed in the Homestay premises.

 

LUGGAGE: Guests are requested to get their baggage inside the homestay , our caretaker can also offer a helping hand if required for heavy luggage. Guest will be responsible for any glass item or breakable item in the luggage . Valuables should be kept under the lock and key , homestay shall not take any responsibility for any losses or damages.

GUEST VALUABLES: Guest have to take care of the valuables in their luggage or rooms during the stay, Homestay / staff will not be responsible for their safety or security. Guest must disclose on arrival about their valuables and carry such items along while going out of the property.

DAMAGES TO PROPERTY: Guests shall be liable for any damage, except normal wear and tear to HOMESTAY asset. Guest shall keep the Homestay room in a good condition and maintain hygiene and cleanliness. The homestay reserves the right to charge guests the cost of rectifying damage or soiling, caused by accidental, deliberate, negligent or reckless act of the guest to the property or structure.

 

SMOKING; No Smoking Policy for Homestay, We really take pride in keeping all our rooms fresh and clean, and discourage smoking in the rooms. In case guests wish to smoke, the Homestay staff will be happy to assist .

Check-in/ Check-out: In the interests of security and to prevent fraud, at the time of check-in, guests may be required to confirm their identity by providing their booking reference and their passport/identity card/driving license. These records will be kept for at least 12 months and may be disclosed or made available for inspection by any police officer or as otherwise required by applicable law in connection with the prevention or investigation of crime. The information above may be requested for each member of your party over the age of 12 and we reserve the right to refuse entry to persons who cannot provide the information set out above.  Rooms are subject to maximum occupancy rules set by Homestay. To respect local traditions, unmarried/unrelated couples may not be allowed to check-in. Accommodation can be denied to guests posing as a couple if suitable proof of identification is not presented at the time of check-in.

PAYMENTS POLICY :

* We require 50% of booking as advance payment to guarantee the rooms at the time of booking.

* Full payment for the entire stay before 15 days of Check-in date .

* All Extras and dues need to be settled before the Check-out date.

* Cancellation or no-show will result in the forfeiture of the prepayment as per the cancellation policy displayed below.

* We do not fall under GST category and do not charge the same from guest if booked directly.

 

CANCELLATION POLICY:

  • Booking cancelled before 24 Days of date of arrival , No cancellation charge applies.

  • Booking Cancelled between 24 to 12 Days , more than 12 days from date of arrival , 50% of the total booking amount is charged.

  • Booking Cancelled Less than 12 Days from date of arrival , full booking amount will be charged as retention.

 

CHILDREN/ EXTRA ADULT POLICY; Stay of 1 child up to 5 years of age is complementary without the use of extra mattress.

Child between 5-12 years if sharing room /bed with parents will be free, Breakfast charges may be applicable for the child.  Extra Bed will be provided for triple occupancy bookings on extra charges.

FORCE MAJUERE :

Force Majeure (FM)— referred also to as Forced Circumstances—is a contractual clause that’s invoked during certain emergency situations (Political/Medical/ Natural Calamities) where it’s impossible for a party to fulfill their contractual obligations due to events beyond their control.

For bookings where guests can’t complete their stay and which meet the FM conditions, the guests can request for one of the following points , with valid reasons supported by documents/proofs of Force Majeure:

  • Find new dates for a future booking as per availability in same financial year (different rates may apply – the difference is paid by the guest) and new dates will be non-refundable and non-changeable.

  • Issue a voucher for a future stay, with the same value as the original price paid by the guest (or a higher amount as per season)

  • Issue a full refund of any prepayment or deposit, for no-shows, booking changes, or cancellations 

FOOD & BEVERAGES POLICY: We have inhouse Kitchen with expert chefs and the service boys to facilitate the inhouse guests. All meals  (breakfast , lunch , Evening tea and Dinner ) are available as per the timings set by the management . Any special request needs to be made 24 hrs prior and will be chargeable as per actual price set. Guests on meal included in package will be offered fixed menu each day which can be changed on one day prior notice , else the menu will be as per Chefs choice. Our Chefs have expertise mainly in traditional Kashmiri Non-veg and Veg cuisine , the Indian  pure vegetarian cuisine is also available . Only Soft beverages are available at the property.

 

PARKING: Guest can make use of the open non-covered car parking area within the premises free of charges during their stay. Cars and their contents are left at the owner’s/customer’s own risk. We do not accept responsibility for any loss or damage.

 

PROHIBITED ITEMS / ACTIVITIES:

The following items are not permitted in the  Cottage/Homestay premises:

  • Animals of any kind, except guide dogs

  • Flammable, explosive or otherwise hazardous materials

  • Objects emitting a foul odour

  • Unregistered firearms or other weapons

  • Objects of an unusually large size or in unusually large quantities

  • Articles related to use in gambling, prostitution, smuggling or other illicit acts

  • Illegal drugs or other articles, the possession of which is prohibited by the laws of J&K.

  • Illegal relationships, gambling , prostitution, illicit behaviour, fire works / crackers, fighting /scuffling , eve teasing, disturbing other guests in any manner.

 

CCTV Coverage : For the safety and security of the guest and as per guidelines of MOT and J&K UT Govt CCTV are necessary at all strategic location , this property has CCTV in place at such points inside and outside the property.

 

The Homestay reserves the right to refuse entry to any guest found to be in possession of prohibited items. Guests shall be solely liable and responsible for all loss financial or otherwise, and damage that may be caused by such items.
